Agreement to Terms

By booking an expedition with Whale Expedition International ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. Please read them carefully before making a reservation.

Booking and Payment

  • A non-refundable deposit of 30% is required to confirm your booking
  • Full payment is due 60 days prior to departure
  • Bookings made within 60 days of departure require full payment at time of booking
  • Prices are quoted in EUR unless otherwise stated
  • We reserve the right to adjust prices due to currency fluctuations, fuel surcharges, or tax changes

Cancellation Policy

Cancellations must be made in writing. The following cancellation fees apply:

  • More than 90 days before departure: Loss of deposit (30%)
  • 60-90 days before departure: 50% of total expedition cost
  • 30-59 days before departure: 75% of total expedition cost
  • Less than 30 days before departure: 100% of total expedition cost

We strongly recommend purchasing comprehensive travel insurance to protect against unforeseen circumstances.

Travel Insurance

Comprehensive travel insurance is mandatory for all participants. Your insurance must cover medical expenses, emergency evacuation, trip cancellation, and personal liability. Proof of insurance must be provided prior to departure.

Health and Fitness Requirements

  • Participants must be in good physical health and able to swim
  • All pre-existing medical conditions must be disclosed at time of booking
  • Participants may be required to provide medical clearance for certain conditions
  • Pregnant women cannot participate in in-water activities
  • We reserve the right to refuse participation if safety concerns arise

Wildlife Encounters

Please understand that:

  • Wildlife sightings are not guaranteed as we work with wild animals in their natural habitat
  • Weather and sea conditions may affect expedition activities
  • Itineraries may be modified based on wildlife behavior and environmental conditions
  • Animal welfare always takes priority over participant expectations
  • No refunds are provided for missed wildlife encounters or weather-related changes

Safety and Conduct

  • Participants must follow all safety instructions from expedition leaders
  • Alcohol consumption must be moderate and responsible
  • Illegal drugs are strictly prohibited
  • Disruptive behavior may result in removal from the expedition without refund
  • Participants are responsible for their own actions and behavior

Liability and Assumption of Risk

Expedition activities involve inherent risks. By participating, you acknowledge and accept these risks. The Company, its employees, and partners are not liable for any injury, loss, damage, or expense arising from participation in expedition activities, except where caused by our negligence or willful misconduct. Participants are responsible for their own personal belongings and equipment.

Travel Documents

Participants are responsible for obtaining valid passports, visas, and any required travel documentation. The Company is not responsible for denied entry or additional costs due to invalid or missing documentation.

Photography and Media

By participating in our expeditions, you consent to being photographed or filmed for promotional purposes. If you prefer not to be featured in our marketing materials, please notify us in writing.

Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our control, including but not limited to: natural disasters, war, terrorism, government restrictions, pandemics, or other acts of God. In such cases, we will work with you to reschedule or provide alternative arrangements where possible.

Complaints and Disputes

Any complaints must be reported immediately to the expedition leader. Written complaints should be submitted within 14 days of expedition completion. We will investigate all complaints and respond within 30 days.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services constitutes acceptance of any modifications.

Governing Law

These Terms and Conditions are governed by and construed in accordance with applicable international travel laws. Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
